1. Who we are

Therapy & Wellness is the private counselling practice of Denisha Kotze (operating at wellnessco.co.za), a Specialist Wellness Counsellor registered with the Association for Supportive Counsellors and Holistic Practitioners (ASCHP number SWC24/5059).

For the purposes of the Protection of Personal Information Act, 2013 (POPIA) Denisha Kotze is the responsible party.

2. What personal information we collect

We collect personal information in the following ways:

  • Contact form and direct enquiries. Your name, email address, phone number, and the message you send us, whether via the contact form on this site, WhatsApp, SMS, email, or phone.
  • Counselling file. If you become a counselling client, we keep session notes, correspondence, and any information relevant to your counselling. This is kept separately from the information collected via the website.
  • Website analytics. Aggregated, pseudonymous data about how visitors use the site, via a self-hosted Umami analytics instance at analytics.prolificstudio.co.za, operated on our behalf by Prolific Studio. Umami does not use cookies and does not collect personal identifiers.

Information you share with us via the contact form or in correspondence may include details about your mental or physical health, or other sensitive personal information. Under POPIA section 26 this is "special personal information". We rely on your consent (POPIA section 27) to process it, given by your choice to contact us. You can withdraw consent at any time.

3. Why we process your personal information

We use personal information for the following purposes:

  • To respond to your enquiries and to arrange consultations. Lawful basis: your consent (POPIA s. 11(1)(a)); performance of a contract for services if you become a client (POPIA s. 11(1)(b)).
  • To provide counselling and keep records appropriate to the counselling relationship. Lawful basis: contract and legitimate interest in professional record-keeping, in line with ASCHP ethical requirements.
  • To improve the website via aggregated analytics. Lawful basis: legitimate interest in understanding how the site is used, limited to pseudonymous, cookieless data.
  • To meet legal and professional obligations, for example responding to lawful requests from a court or regulator. Lawful basis: legal obligation.

4. Who we share your information with

We share personal information only where necessary:

  • Our mailer service provider (Prolific Studio, operating at mailer.prolificdev.co.za, based in South Africa). When you submit the contact form on this site your message is relayed through that service to our email inbox. Prolific Studio processes the information on our behalf and is bound by a data processing arrangement.
  • Our hosting providers, including GitHub (for source and container registry) and the VPS and CDN (Cloudflare) we use to serve the site.
  • Legal or regulatory authorities, only where required by law, a court order, or an obligation under our professional association.
  • Other specialists where a referral is clinically appropriate, and only with your explicit consent.

We do not sell personal information, and we do not share it for marketing purposes.

Some of our service providers (including Cloudflare and GitHub) operate infrastructure outside South Africa. Where personal information is transferred across borders, we rely on the safeguards required under POPIA section 72.

5. How long we keep your information

  • Contact form submissions and enquiry emails: retained for up to 24 months, then deleted, unless you become a counselling client.
  • Counselling records: retained for the period required by ASCHP professional standards, currently a minimum of five years after the end of the counselling relationship.
  • Aggregated analytics: retained for 24 months for trend analysis, then deleted.

6. Your rights

Under POPIA you have the right to:

  • Access the personal information we hold about you.
  • Correct inaccurate or incomplete information.
  • Request deletion of your personal information, subject to legal and professional retention requirements.
  • Object to processing based on legitimate interests, or for direct marketing (we do not do direct marketing).
  • Withdraw consent where processing is based on consent.
  • Complain to the Information Regulator of South Africa: inforegulator.org.za, [email protected], +27 10 023 5200.

To exercise any of these rights, email [email protected]. We will respond within a reasonable time and no later than 30 days.

7. Security

We take reasonable technical and organisational steps to protect personal information. The website is served over HTTPS with HSTS. Counselling records are kept under access control. Contact form submissions are transmitted over TLS to our mailer service and from there to the counselling inbox.

Please avoid sending sensitive personal or health information (such as diagnoses, medication details, or trauma history) via unencrypted email or messaging apps. If you have sensitive material to share, we can arrange a secure channel during your first session.

8. Cookies

See our Cookie Policy for details. In short, this site does not use cookies for tracking or advertising. Our analytics provider (Umami) is cookieless by design.

9. Children

This counselling practice works with adolescents, students, adults, and the elderly. Where a client is under 18, informed consent from a parent or legal guardian (the "competent person" as defined in POPIA section 35) is required before counselling begins. Processing a minor's special personal information for counselling purposes is done on that competent-person consent basis. The website is not directed at children under 13 and we do not knowingly collect personal information from them.

10. Changes to this policy

We may update this policy from time to time. The "Last updated" date above reflects the most recent change. Material changes will be flagged at the top of the page for a reasonable period.
